Terms of Service
Use this free service to send your friends, family, and colleagues talking messages from Austin Halloween Icon, Mr. Creep.
Your use of the Site constitutes your consent to be bound by these terms of use (the “Terms”). If you do not agree to be bound by these Terms, do not use the site. Unauthorized use terminates the permissions and licenses granted below. Under these Terms, House of Torment offers users the ability to (a) use the service, and (b) preview and/or transmit content. By using the service you agree to be bound by these Terms, including, without limitation, your agreement to limit or excluder certain damages and remedies.
1. Service Description. This service makes available the ability to send a person an audio message (the “Message”) via telephone. Please use your best judgment and be respectful of other individuals. The Service is provided to give our users an interesting and fun forum in which they entertain their family, friends, or colleagues. In any dispute, you agree to bear all costs and liability arising from your use of this service including without limitation the actual call cost(s), if any, to the receiving party(ies) to whom you send calls. In no event shall House of Torment assume or have any responsibility or liability for any claims, damages, or losses resulting from your use of this site. House of Torment reserves the right at all times to disclose any information (including the identity of the persons providing information) as necessary to satisfy any law, regulation or governmental request.
2. House of Torment does not warrant or make any representations of any kind or nature with respect to the Message. Therefore you are responsible for compliance with local laws, if an to the extent local laws are applicable. You hereby acknowledge that the use of this Service is at your sole risk. You must be at least 13 years old to transmit a Message and you must verify that the person you are sending the Message to is also 13 years old.
3. License. In accordance with these Terms, House of Torment grants you a non-exclusive, non-sublicensable, non-transferable, terminable license to view and use the Service only for the purposes of transmitting Messages that are transmitted to you or by you via the Service (the “Materials”), in each case in accordance with these Terms. You do not have the right to separately copy or reproduce any Materials apart from you use of a web browser to access the service or make a transmission. House of Torment reserves the right to suspend or deny, in our sole discretion, your access to all or any portions of this website and Service.
4. Use Restrictions. You may not (a) use any device, software or routine to interfere or attempt to interfere with the proper working of the Service, (b) take any action that imposes an unreasonable or disproportionately large load on our infrastructure, (c) copy, reproduce, alter, modify, create derivative works, or publicly display any Materials, from the Service without prior written permission from House of Torment, or as permitted by applicable law.
5. Use Conditions. You may use the Service only for its intended purposes. House of Torment reserves the right to refuse Service or take other appropriate action with respect to such Materials, information, or files, which House of Torment for this Service, in its sole discretion, deem objectionable or as a nuisance. You are hereby notified that use of the Service constitutes consent to such actions, monitoring and auditing.
6. Use Charges. Neither House of Torment have any liability to you for use charges related to any device that you use to access the Service of use and receive House of Torment’s Materials, including, without limitation to, charges for mobile phones, smart phones and other devices, whether wireless, wireline, requiring cradle synchronization or otherwise.
7. Agreement to conduct transactions electronically. You agree that all of your transactions with or through the Service may, at our option, be conducted electronically. You also agree that House of Torment may provide all agreements, disclosures and notices electronically, including any the House of Torment is otherwise required to provide in writing.
8. Your Representations and Warranties. You represent and warrant for the benefit of House of Torment that while using the Service (a) you possess the legal right and ability to enter into and make the representations contained in these Terms, (b) all information submitted by you to the Service is true and accurate, (c) you will not use the Service for any purpose that is unlawful or prohibited by these Terms or applicable law, including, federal, state, or local law which may specifically apply to your use of this Service.
9. No Warranties. THE SERVICE MATERIALS AND PRODUCTS OFFERED AT THIS SITE ARE PROVIDED TO YOU “AS IS” “WHER IS” AND WITH “ALL FAULTS.” HOUSE OF TORMENT MAKES NO WARRANTY OF ANY KIND, AND HEREBY DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INLCUDING, BUT NOT LMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AVAILABILITY OF THE SERVICE OF CONTENT; RELIABILITY, TIMLINESS, CURRENCY, OR USEFULLNESS OF ANY INFORMATION ON THE SITE; AND ANY DUTIES OF REASONABLE CARE.
10. Limitation of Liability Damages. TO THE FULLEST EXTENT ALLOWED BY LAW, YOU AGREE THAT NEITHER WE, NOR ANY OF OUR AFFILIATES OR AGENTS, WILL BE LIABLE TO YOU AND/OR ANY OTHER PERSON FOR ANY INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF DATA) OR ANY PUNITIVE DAMAGES WHATSOEVER THAT ARISE OUT OF OR ARE RELATED TO THE SIT, OR THE MATERIALS, OR TO ANY BREACH OF THESE TERMS, EVEN IF HOUSE OF TORMENT, HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TOTAL LIABILITY HEREUNDER IS LIMITED TO THE AMOUNT, IF ANY, ACTUALLY PAID BY YOU FOR ACCESS AND USE THE SERVICE OF TO PURCHASE MATERIALS. SOME JURISDICTIONS MAY NOR PERMIT THE PRECEDING LIMITATIONS AND THEREFORE SUCH PROVISIONS MAY NOT APPLY IN THOSE JURISDICTIONS.
11. Amendments; Complete Agreement. You agree that House of Torment may from time to time amend or add these Terms (“Amendments”), including without limitation, Amendments that add registration fees, or change payment methods or requirements. Notice of such Amendments will be posted on the Site and each such Amendment will be effective immediately after notice. Your use of the Service after the effective date of any Amendments shall be your consent to those Amendments and to these Terms as amended. If you do not want to be bound by an Amendment, you will need to refrain from using the Service, Site or content after that date. These Terms and any Amendments, any consents provided by you, the disclosures provided by us on the Site and in conjunction with Materials and User Content delivered or accessible via mobile phone, constitute the entire agreement between you and us and supersede any prior and contemporaneous written or oral agreements between the parties.
12. No Waiver Serverability. The failure either party to enforce any provision of these Terms shall not be construed as a waiver or limitation of that party’s right to subsequently enforce and compel strict compliance with every provision of these Terms. If any provision of these Terms shall be held to be invalid or enforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of these Terms is invalid or unenforceable, but that by limiting such provision it would become valid or enforceable, then such provision shall be deemed to be written, construed and enforced as so limited.
13. Applicable
Laws. Any claim related to the use of
the Site, Service, or to the Site or Service content shall be governed by,
construed and enforced in accordance with the laws of the State of California
without regard to its conflicts of laws provisions. Any action brought in connection with the
Site, Service, Materials, of User Content, or any other House of Torment
content or services shall be brought in either the state or federal courts with
jurisdiction in the City and
